PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE



Contract of Sale



FORMATION OF THE CONTRACT



Subject to these terms and conditions you agree to purchase and Momentoes agrees to sell the goods in accordance with the order form between you (The customer) and the seller (Momentoes)It is your (The customer’s) responsibility to ensure that the order confirmation is accurate.



DESCRIPTION AND PRICE OF THE GOODS



The description and the price of the goods you order will be as shown in the order and shall remain valid for 30 days from receipt by you.



If an error in any of the details on the order are found by Momentoes we will inform you as soon as possible and offer you an option of reconfirming your order at the correct price or cancelling your order.



PAYMENT



Payment for the goods shall be made when you place your order



100% payment at the time of order.



Full payment must be received before we ship any product.



DELIVERY



Shipping times described are working days. Please check specified item for delivery.



The estimated date of delivery will be as set in the order Momentes will not have any liability for a failure beyond our reasonable control to deliver by the estimated date of delivery.



All impression kits are sent out within 3 working days, charms usually 30 days although this can vary in peak times.



Where prints have been returned and cannot be used (due to them not being defined enough, too dark or too light of a print) another kit will need to be send out, at a cost to the customer. We will advise if this is the case and it will lengthen the time it takes to dispatch the charms.



All P&P for finger print jewellery is free. All other products shipping will be added at check out.



We currently only ship within the UK.



Please ensure address is correct. We CANNOT be held responsible if the address is incorrect and your item is shipped there. 

 



ACCEPTANCE OF THE GOODS



You must check the goods on delivery. If the goods are delivered damaged or faulty you must inform us within 48 hours of delivery. If you do not inform us within 48 hours we will take no liability for the damaged or faulty goods. This does not affect your statutory rights.



You will be responsible for your goods once delivery is made.



EXCLUSIONS OF LIABILITY



The customer acknowledges that it has been advised that the production process used for fingerprint items is inappropriate for children less than 2 years. Therefore we recommend hand or foot prints until after 2 years of age.



We cannot guarantee that any person of any age will produce a well defined fingerprint. This varies from person to person, regardless of age.



The customer acknowledges that due to the purity of fine silver .999 jewellery is softer than .925 silver and therefore needs to be handled with special care. If worn every day the item may show signs of wear and tear and the detail may fade. This is more prevalent with charm bracelets, rings and keyring’s which are more prone to being knocked against hard surfaces.



YOUR CONSUMER RIGHTS - Refunds, Cancellations and Faulty items



Personalised items



 



Due to the items being personalised and custom made to order, we are unable to accept cancellation of orders once any work has commenced.



 



Hand crafted jewellery



 



For personal items, orders may be cancelled and a full refund given at any point until a print kit has been dispatched or work has commenced (Whichever occurs first) Once a kit has been dispatched we will make a small charge to cover the costs of the kit and the remaining balance will be refunded.



 



 



 



Where an item is faulty or wrongly personalised such as wrong spelling (i.e. different from the initial request) we will only send out a replacement or repair, free of charge on receipt of the faulty item (the cost of which will be refunded by us).



 



NB Please note that because the jewellery and keepsake items are made by hand there will be tiny imperfections such as scratches or words not lined up completely straight, however, this is not considered an error or incorrect personalisation but instead adds to the handmade nature of the work.



 



Please also be aware that as every item is made by hand and especially with fingerprints, items received may vary slightly from pictures and may require some artistic licence on our part with placements of prints.



 



*We reserve the right to place words and prints where we believe it will suit the piece based on the size etc. of what is ordered. This is the case with fingerprint jewellery and stamped items.



 



We will not offer a refund or exchange on products if you have made a mistake on the order form. Please ensure you fully check this before signing and placing your order.



 



Manufactured Personalised gifts 



Please double check your personalisation as how it appears here will be how it appears on the product, including spacing and punctuation.

Please do not include accents and special symbols as our processes will not allow this. This includes accents above and below the alphabetical or numerical text. If you enter these characters they will be replaced or removed No other characters can be used, no texting shortcuts or images like hearts < 3. Basic punctuation symbols like those found on a standard computer keyboard are acceptable.



Due to the font type used please refrain from using all capitals in your personalised message. If the message is all in capitals you will find the personalisation extremely difficult to understand and may even result in personalisation being missed off the product.



Personalised items take time to be manufactured, the expected despatch time is shown against each product.





As all items are made to order, we do not accept returns on personalised items, so please double check names, dates and spellings before ordering.

If your item has a manufacturing fault, or damaged in transit, please contact us, including a photo if appropriate and we can arrange a replacement.



Engraving



Engraving will be word for word from your instructions – No responsibility will be taken for spelling errors



A layout will be chosen for the best fit, responsibility cannot be taken if you do not like layout.



The items are engraved with a fine needle. The images will appear clearer in some lights than in others just as any engraving. Please note that these are not made in colour.



Colour



Please note that the colour of the product you receive may not match the colour as displayed on your computer monitor, if the colour is important to you you place the order at your own risk.





Non-Personalised items



Under the Distance Selling Regulations and Consumer Credit Contracts effective 13th June 2014, you as the consumer enters into a contract with us as soon as payment is made and therefore can cancel your contract with us at any time between the date the payment was made up to 14 days after the Royal Mail tracking system says it has been received by the addressee.



The costs of sending the items back due to cancellation will be met by the consumer and a refund will be given in the same manner as it was received within 14 days of the item being received by us. We do however reserve the right under the regulations to deduct an amount from the refund if the goods have been returned in a way that has diminished the value of the goods by handling them beyond that is necessary to establish their nature, characteristics and function.



*Please note that unless specifically requested we reserve the right to use the photos and testimonies that we take of your charms for marketing purposes on our website, Facebook and when demonstrating to customers our capabilities.





Data Protection and Privacy Policy

The information that is collected and held by us (such as addresses and email addresses) are held in accordance with the Date Protection Act 1998 and are never passed to a third party but is used for our own accounting and marketing purposes only. Please note that you can at any time contact us to have your email address removed from the list



These terms and conditions are governed by English law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.



CANCELLATIONS

If you wish to cancel your order before you receive our confirmation email, please email momentoesgifts@yahoo.co.uk with CANCELLATION as the subject line.
